Nashik TCS Case: Victim Breaks Down as Bail Pleas Rejected

The Nashik Sessions Court has rejected the bail applications of five accused in a serious case involving allegations of sexual harassment, mental harassment, religious sentiment violations, and attempted forced conversion at a Nashik-based office of Tata Consultancy Services. The decision has kept all accused in judicial custody as investigations continue.
According to the court proceedings, the accused include Ashwini Chenani, Raza Menon, Asif Ansari, Shahrukh Qureshi, and Tausif Attar. The court’s ruling came after detailed arguments from both the prosecution and the defense, with the public prosecutor strongly opposing bail on the grounds that releasing the accused could lead to them absconding or influencing witnesses.
A significant aspect of the case is the court’s observation regarding Ashwini Chenani, who served as the site head and was also a member of the Internal Committee under the POSH (Prevention of Sexual Harassment) Act, 2013. The court noted that she allegedly failed to respond appropriately to the victim’s complaint and was accused of ignoring reports of harassment and forced conversion. The judge further observed that her silence and alleged insensitivity may have contributed to a toxic work environment and, as per the court’s remarks, could amount to abetment in the alleged wrongdoing.
Defense lawyers argued that Chenani was primarily based in the Pune branch and did not directly supervise day-to-day operations at the Nashik site. However, the court did not find this argument strong enough to grant bail, noting that her role in the Internal Committee meant she was still responsible for addressing such complaints promptly and effectively.
During the hearing, the courtroom reportedly became highly emotional when one of the victims personally narrated her experience before the judge. The victim stated that the pressure and fear created by the accused were so severe that two other women allegedly left Nashik out of fear for their safety. This testimony played a key role in highlighting the seriousness of the allegations before the court.
The prosecution emphasized that the case involved sensitive issues, including workplace harassment and alleged coercion related to religious conversion, making it crucial that the accused remain in custody during the investigation phase. The court agreed with this stance and rejected all five bail applications.
With the bail pleas dismissed, all accused will remain in central jail while the case proceeds further. The ruling marks an important stage in the ongoing legal proceedings, as investigators continue to examine evidence and witness statements related to the allegations.
